Supreme Court Hears Oral Arguments in Stock Drop Case

The Supreme Court recently heard oral arguments on Fifth Third Bancorp v. Dudenhoeffer. ERIC had filed an amicus brief in the case urging the Court to uphold the presumption of prudence (as recognized by most courts of appeal that have ruled on the issue) regarding employer shares fund and ESOPs. The arguments were well attended by both the public and the media, although it’s possible that the media was more focused on the Court’s issuance of its opinion in McCutcheon v. Federal Election Commission regarding campaign contribution limits.
