The parties in the case of
Heimeshoff v. Hartford Life & Accident Insurance Co. have been filing briefs with the U.S. Supreme Court. The Court will hear the case on October 15th. The
Heimeshoff case addresses how long participants have to file a lawsuit when there is a denial of benefits. Briefs by the participant and her supporters and a joint brief by the U.S. Solicitor General and Department of Labor were filed last month. Briefs for The Hartford and its supporters are due this month.
The Supreme Court’s decision in this case will impact the length of time that a participant has to file suit when a plan denies a benefit claim.
